A trend is growing among celebrities to approach the Delhi High Court to protect their personality and publicity rights.
Recently, a host of Bollywood actors Aishwarya Rai Bachchan, Abhishek Bachchan, Hrithik Roshan, filmmaker Karan Johar, and Telugu actor Akkineni Nagarjuna sought protection. The court granted them interim relief.
Few days ago, Singer Kumar Shanu also has been granted protection rights by the Delhi High Court. “I am deeply grateful to my advocate, Sana Raees Khan, for her powerful and masterful arguments that led to this significant victory in court. “My heartfelt thanks to the Hon’ble Delhi High Court for recognizing and upholding my Personality Rights. This landmark judgment is not just a personal win, but a strong precedent in safeguarding every artist’s identity, voice, and creative expression,” Sanu said on X.
Commenting on the move, a senior advocate said these legal protections guard against the unauthorised commercial use of a person’s name, image, voice, likeness or even signature catchphrases.
Recently, the Delhi High Court granted interim protection to actress Aishwarya Rai restraining various online platforms and entities from misusing her name, images, and attributes of personality for commercial or personal gain without her consent. The order, passed by Justice Tejas Karia on September 9 came in response to a plea filed by Rai seeking protection of her personality rights against unauthorised exploitation, including AI-generated pornographic content. “The courts in such cases of unauthorised exploitation of one’s personality rights, can’t turn a blind eye to the same and shall protect the aggrieved parties so as to avert any harm to them resulting from the said unauthorised exploitation.” the court said
