Woman may get job despite her mother being made nominee by late husband

The Uttarakhand High Court has asked the state forest department to consider giving job to a woman whose husband, who died in 2020, had made his mother-in law as nominee in the service record.

The woman has filed a petition before the High Court pleading that she be given job in the state forest department on compassionate ground despite her late husband Kishan Singh Dhapola nominating her mother as legal nominee.

The single bench of Justice Manoj Kumar Tiwari held that since the forest department had already recognized the petitioner as the legal wife of Dhapola by releasing a portion of the GPF amount, her claim for compassionate appointment should also be considered within three months.

Due to strained relations with his wife, Dhapola had entered his mother-in-law’s name as a nominee in his service records, instead of his wife. Following his death, the Forest Department rejected his widow’s claim for compassionate appointment based on the service record.

The widow filed a petition in the High Court, which directed the Forest Department to decide her claim for compassionate appointment within three months, as required by law, since it had already released a portion of the deceased employee’s General Provident Fund (GPF) to his widow, recognizing her as his legal wife.
